Pat Parker, a political researcher, had been asked by the State Academy of Trial Lawyers to sell them a copy of Parker’s research done two years earlier. The research had been done for the Democratic Party on the Republican candidate for Attorney General, but had not been used. Parker reasoned that the trial lawyers wanted to use that research in the upcoming election to inoculated the current Attorney General (a Republican). Parker had two reasons to hesitate selling this research, the possible copyright infringement and the fact that Parker personal preference to work only for Democrats.
