It was over ten monthes since Maria had been sentenced to death for the murder of Domenico Cataldo on April 26, 1895. Almost two weeks ago, I had presented to Judge Goff that Maria was given an unfair trial. I brought foward evidence that at the time of the murder Maria was not in functioning mental capaity. I stated how she suffers from episispy and has random periods of "black-outs".
A mojor discrepency of the first trial was Maria was an immergrant from Italy. Her family immigrated to the United States in 1892. She barely spoke english and clearly did not know anything about the criminal justice system. Also, the jury that was chosen for her case was all males and none of them were Italian.
