Issue: The issue consists of whether or not the Federal Constitution gives a fundamental right for homosexuals to practice in the act of sodomy and therefore deny the States the rights to create or uphold laws that make these acts illegal.
Facts: The rights of these State laws restricting sodomy have been in effect since the States began. In 1964 a violation of one of these laws was sentenced by twenty to thirty years imprisonment. In 1982 a man in Georgia was charged with the criminal act of same sex sodomy while in his bedroom. The matter was dropped without further evidence of the act, however the respondent filed claims in Federal District Court.
