Australia, along with many other countries, signed the 1951 Convention on Status of Refugees and had provided refuge ever since (UNHCR 2002a). The definition of refugees under the Convention is people who had no choice but to escape from their country to seek asylum from another country, as they were afraid of being maltreated for the reasons of race, religion, and nationality, membership of a group or political opinion (Healey 2003). While refugees are being separated into two groups, the legal and illegal refugees, Australia’s policy had treated them differently.
