What is sexual orientation? Sexual orientation, also called affinity orientation, is when an individual is intimately attracted to his or her own gender. Basically, this applies to gays and lesbians. Discrimination based on sexual orientation is obviously present in the case of Tracy not getting a promotion for being her true self, a lesbian. Unfortunately, this discriminatory act by her manager Ms. Green, as of today is not protected by Title VII. Let’s look at the brighter side. Tracy is protected under California Government Codes Sections 12920 and 12921. The first, is a public policy of the state necessary to protect and safeguard the right and opportunity of all persons to seek, obtain, and hold employment without discrimination
