The question, “Were the colonists British subjects?” must be accompanied by a host of other deliberations such as, “Were the colonists subject to the common laws of England?” Did they enjoy the fundamental rights of British subjects, or were the colonies just dominions of the king, and as a result, outside of that sphere? Or, does the nature of the founding of the colony play a part in its constitutional stance as to whether or not the people living in it were subject to the laws of England, and if not, to whom?
