Was the pinto ford defective in design?
Rule.
Under the defective rule design, the following conditions applies:
· The manufacturer knew of the design flaw
· The manufacturer knew that there was a likelihood that the flaw would cause injury;
· The flaw, in fact, caused the foreseen injury; and
· Reasonable alternative designs existed at the time of manufacture.
Rule 11
Restatement (Third) of Torts: Products Liability § 2(b). Section 2(b) provides:
